Welcome to True North Memories! These Terms of Service ("Terms") govern your use of our website and the purchase of custom products from our store. By placing an order, you agree to these Terms.

2. Shopify Hosting

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

3. User-Submitted Content & Intellectual Property

True North Memories provides a custom printing service. By uploading images, designs, or text ("User Content") to our website, you confirm, represent, and warrant that you own the intellectual property rights to the User Content, or that you have obtained explicit, written permission from the copyright or trademark owner to reproduce it.

We strictly respect intellectual property rights in Canada, the United States, and worldwide. You agree that you will not upload any material that infringes upon the copyrights, trademarks, or privacy rights of any third party (including, but not limited to, professional photographs, sports team logos, brand logos, and licensed characters).

4. Right to Refuse Service

We reserve the right, at our sole discretion, to review all uploaded User Content. We hold the right to refuse to process, print, or fulfill any order that we reasonably believe may violate intellectual property laws, or that contains material deemed illegal, offensive, threatening, defamatory, or inappropriate. In such cases, the order will be cancelled and your payment will be refunded.

5. Indemnification

By submitting an order, you agree to fully indemnify, defend, and hold harmless True North Memories, its owners, employees, and affiliates from any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from any third-party claim that the printing or distribution of your uploaded User Content violates their intellectual property rights.

6. Products, Pricing & Print Quality

While we strive to reproduce your images as accurately and beautifully as possible, variations in monitor settings, screen brightness, and the physical printing process mean that the colors of your final physical magnets may differ slightly from what you see on your screen. We are not responsible for low print quality resulting from low-resolution, dark, or blurry images uploaded by the user.

7. Orders & Taxes

Your order is an offer to buy. A binding contract is formed when we send you an order confirmation email. Applicable sales taxes, duties, and government fees will be calculated or assessed based on your shipping destination.

8. Statutory Consumer Rights

Nothing in these Terms limits your statutory rights under applicable local, national, or federal consumer protection laws (including PIPEDA and CASL where applicable). Where a clause conflicts with a mandatory statutory right, the statutory right prevails.

9. Limitation of Liability

To the fullest extent permitted by law, our liability is limited to the amount you paid for the order giving rise to the claim. True North Memories shall not be liable for any indirect, incidental, or consequential damages arising from your use of the site or products.

10. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without prejudice to mandatory consumer-protection rules of your jurisdiction of residence.
